Should I talk to the at-fault party’s insurance company?
If you hire an attorney from the outset, your lawyer will handle all communications with the insurance company. Many times, though, people start the claims process themselves before realizing they need to hire an attorney. If you call the at-fault party’s insurance company to make a claim, or if the insurance company contacts you because their insured let them know about the accident, be careful what you say. They will start by letting you know they will be recording the call. This recorded call can later be used against you to make you appear uncertain or inconsistent in your description of the accident. It is better to decline to have the call recorded and have an attorney contact them instead.
